Acceptance and Definitions:

By enrolling in Patient Success Concepts (“PSC”), you acknowledge and agree to these Terms and Conditions. Acceptance is signified by checking the acceptance box on our website during the enrollment process.

Naturally Inclined Health is offering the PSC program for educational purposes only. The program is facilitated by Dr. Amber McKinnon ND and Mandy Megan Conyers-Smith RD (the “Facilitators”).

Naturally Inclined Health reserves the right to change these Terms and Conditions or to impose new conditions on the participation in the PSC program, from time to time, current Terms and Conditions will be maintained at XXXX. By continuing to participate in the PSC program, you accept the Terms and Conditions as modified.

You must be at least 18 years of age to participate in PSC and Material. By accessing the Site and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age.

 

 

Registration

To access PSC, we will ask you to provide certain demographic and identifying information. You agree to provide true, accurate, current and complete information about yourself as prompted by the PSC registration form. If we have reasonable grounds to suspect that such information is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your enrollment and refuse any and all current or future access to the PSC program and Materials (or any portion thereof). Our use of any personally identifiable information you provide to us as part of the registration process is governed by the Terms outlined here.

 

 

Payment and Fees:

You agree to pay the full Program Fee and applicable taxes. By providing Naturally Inclined Health with your credit card number and associated payment information, you agree that Naturally Inclined Health is authorized to immediately invoice you for all fees and charges due and payable to Naturally Inclined Health hereunder and that no additional notice or consent is required.

By purchasing the Material (including, but not limited to courses, programs, and memberships), you understand and agree that all sales are final and no refunds will be provided.

Program Fee: The cost of enrolling in Patient Success Concepts (PSC) is $395 CAD, plus applicable Goods and Services Tax (GST).

Refunds: You may request a refund within 24 hours of purchasing the PSC program. Refund requests must be submitted in writing to info@naturallyinclinedhealth.com within 24-hours of purchase. Refunds will be subject to a non-refundable administrative fee of $25 CAD, plus applicable GST. After the 24-hour refund period has elapsed, all sales are final and no refunds will be provided.

Payment Method: Payments can be made using the specified payment methods provided during the enrollment process. Accepted payment methods may include credit card, apple pay or google pay.

 

 

Program Content:

Scope of PSC: Patient Success Concepts (PSC) is a comprehensive educational program designed to empower participants to support their health goals.

Topics Covered: The program includes the following core topics, delivered over five weeks: decisional balance, SMART goal setting, mindset, time management, communications with your health care provider.

Educational Purpose: PSC is intended for educational purposes only. The program content is provided to enhance participants' knowledge and understanding of health goal-related concepts. It is not a substitute for professional medical advice, diagnosis, or treatment.

Materials: Participants will receive access to program materials, including workbooks and slide notes, which are the intellectual property of Naturally Inclined Health Ltd (the “Material(s)”). These Materials are for educational use within the program and should not be reproduced, distributed, or used outside of this context.

Linking: The Materials may contain links to third-party websites and/or information. These links are provided solely as a convenience to you and not as an endorsement by Naturally Inclined Health or the Facilitators of any third-party website or the content thereof. Unless expressly stated, PSC does not operate any third-party website linked to the Materials and is not responsible for the content of any third-party website, nor does it make any representation, warranty or covenant of any kind regarding any third-party website including, without limitation, (i) any representation, warranty or covenant regarding the legality, accuracy, reliability, completeness, timeliness or suitability of any content on such third-party websites; (ii) any representation, warranty or covenant regarding the merchantability and/or fitness for a particular purpose of any third-party websites or material, content, software, goods, or services located at or made available through such third-party websites; or (iii) any representation, warranty or covenant that the operation of such third-party websites will be uninterrupted or error free, that defects or errors in such third-party websites will be corrected, or that such third-party websites will be free from viruses or other harmful components.

 

Interactive Features

PSC may include a variety of features, such as chat rooms, bulletin boards, web logs, social media, and email, which allow feedback to us, real-time interaction between users, and other features which allow users to communicate with others. Responsibility for what is posted on bulletin boards, web logs, chat rooms, and other public posting areas on the Site, or sent via any email services, or connected to Material from PSC, lies solely with each user and Naturally Inclined Health and the Facilitators accept no responsibility for same.  Naturally Inclined Health and the Facilitators do not control the messages, information, or files that you or others may provide through the Site and accept no liability for same.

PSC may host message boards, chats, and other public forums on or made available through the PSC program. Any user failing to comply with the terms and conditions of these Terms may be expelled from and refused continued access to, the message boards, chats, or other public forums in the future. The Facilitators or their designated agents may remove or alter any user-created content at any time for any reason. Message boards, chats and other public forums are intended to serve as discussion centers for users and subscribers. Under no circumstances will Naturally Inclined Health or the Facilitators be liable for any loss or damage caused by your reliance on information obtained through these forums. The opinions expressed in these forums are solely the opinions of the participants, and do not reflect the opinions of Naturally Inclined Health or the Facilitators or any of its subsidiaries or affiliates.

Naturally Inclined Health and the Facilitators has no obligation whatsoever to monitor any of the content or postings on the message boards, chat rooms or other public forums on or made available through the Site. However, you acknowledge and agree that Naturally Inclined Health and the Facilitators has the absolute right to monitor the same at our sole discretion. In addition, Naturally Inclined Health reserves the right to alter, edit, refuse to post or remove any postings or content, in whole or in part, for any reason and to disclose such materials and the circumstances surrounding their transmission to any third-party in order to satisfy any applicable law, regulation, legal process or governmental request and to protect ourselves, our clients, sponsors, users and visitors.

 

 

Attendance and Participation

Expectations: All participants are encouraged to attend and actively participate in all scheduled PSC sessions. Active participation includes engaging in discussions, asking questions, and completing program activities.

Non-Attendance: Failure to attend sessions may result in missed content and opportunities for participation. However, you will have access to session recordings for a 48 hour period following the session and materials to review missed content. Content is intended to be cumulative, catching up on missed material is your sole responsibility.

Code of Conduct:

You are expected to adhere to the PSC Code of Conduct, which promotes a respectful and inclusive learning environment. This includes respectful interactions with fellow participants and adherence to the program's guidelines. Everyone is welcome in PSC. We honor diversity, celebrate individuality, and foster inclusiveness.

Supportive Environment: PSC fosters a positive and supportive community. Participants are encouraged to support their peers, celebrate successes, and provide constructive feedback when necessary.

No Judgment: There are no silly questions, and no judgment is made regarding participants' questions or concerns. PSC values curiosity and encourages open and respectful dialogue.

Questions: If you have questions, chances are so do your peers. Please ask them freely, knowing everyone will respect your thoughts and opinions.

Privacy: Participants are expected to adhere to a Code of Conduct that promotes a safe and respectful learning environment. This includes respecting the privacy and confidentiality of information shared by fellow participants. Any information shared by anyone within the program is expected to be held in confidence by all participants.

Debate and Respect: While debate and diverse opinions are welcome, participants are expected to engage in cordial and constructive conversations. Respect for differing viewpoints is essential.

Comfort Level: Participants have the autonomy to choose their comfort level in discussions. If there is a subject or discussion, they are not ready to participate in, they are welcome to refrain without question.

 

 

Availability of the Instructors:

Instructors will not be available between sessions for immediate responses. However, participants will have the opportunity to submit questions via a digital Google sheet provided by PSC. Instructors will address these questions during the program sessions, in order to foster a collaborative learning environment.

 

 

“Privacy Policy” for PSC:

Your privacy is of utmost importance to us at PSC. We are committed to maintaining the confidentiality of any personal information shared within the program. Here's how our privacy policy for PSC applies:

Confidentiality: All discussions, questions, and shared information within PSC are considered confidential. You are expected to maintain the privacy and confidentiality of your fellow participants and they yours.

Consent: When you provide us with your personal information, you consent to our collection, use, disclosure, and retention of your information in accordance with this Privacy Policy and as otherwise permitted by law. Personal information, including names and contact details, will only be shared within the program with the consent of the individuals involved. We respect your choices regarding the sharing of personal information.

Personal Information: "Personal Information" means information about an identifiable individual that allows someone to identify or contact you, including but not limited to, for example, your mailing address, telephone number, or e-mail address.

Use of Your Personal Information: Naturally Inclined Health uses your personal information for various purposes in connection with our relationship with you for the provision of our products and services, including: (a) to contact and correspond with you regarding your transactions and your use of our products and services; (b) to provide you with information regarding our announcements, promotions, upcoming events, new products, and special features; (c) to facilitate transactions and process orders and payments for products and services purchased by you; (d) to process and respond to your specific suggestions, comments, inquiries and requests, and to otherwise administer our relationship with you; (e) to personalize and improve your experience with PSC; (f) to administer and facilitate your participation in questionnaires; (g) to administer and facilitate your participation in contests and promotions; (h) to create and manage your account; and (i) to develop, deliver, and improve our products, services and advertising.

Naturally Inclined Health may use personal information to create non-personal information, and we may then use, disclose, transfer, and retain the non-personal information in accordance with this Privacy Policy. Non-Personal Information is information that is not associated with or linked to your personal information, including personal information that has been aggregated or otherwise anonymized so that it no longer relates to an identifiable individual.  We may use, disclose, transfer and retain non-personal information for any purpose and in any manner whatsoever.

Data Location: We will store and process your personal information in Canada, the United States, and other countries. The laws of other countries regarding the collection, use, disclosure, and retention of personal information may be different from the laws of Canada and the United States, and their laws may be different from the laws of your country. The disclosure of your information in accordance with this Privacy Policy may result in your personal information being transferred outside of Canada, the United States, or your country.

Data Security: Any data collected as part of the program will be securely stored and used exclusively for program-related purposes. We use reasonable safeguards to protect your information from unauthorized access, collection, use, and disclosure.  While we use reasonable efforts to protect your information, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and therefore, we cannot guarantee absolute security of your personal information.

Data Retention: Personal data collected for the program will be retained for the duration of the program and for a reasonable time thereafter for administrative purposes or as permitted/ required by applicable law.

Platforms: You are agreeing to the privacy policies of Wix, Active Campaign and You Tube.

Intellectual Property:

All course Materials, including but not limited to workbooks, slide notes, and any other content provided within PSC, are the intellectual property of Naturally Inclined Health Ltd. PSC course materials are providing informational, non-commercial and personal use only as authorized under these terms. You agree not to modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create deriviative works, exploit, distribute, or use course materials for any purpose outside of the educational context provided within PSC. You may, however, download, store and/ or print single copies of the Material for your personal, non-commercial use, provided that you maintain all copyright and other proprietary notices.

 

 

Medical Disclaimer

The information and content provided in PSC is for general educational and informational purposes only and is not professional medical advice, diagnosis, treatment or care, nor is it intended to be a substitute therefor.

If you have any concerns or questions about your health, always seek the advice of a doctor or other qualified health care professional.  Do not disregard, avoid or delay in seeking medical advice or treatment from your health care professional because of information within PSC.

You acknowledge and agree that the presentation of information PSC or in the Material does not establish a doctor-patient relationship or any medical relationship of any kind between you the Facilitators.  You understand that that PSC is an educational program and not a substitute for professional medical advice, diagnosis, or treatment. It is essential that you continue to consult with their healthcare providers regarding any medical concerns or conditions throughout the program.

 

 

Disclaimers:

PSC is provided “as is”. While Naturally Inclined Health and the Facilitators endeavor to provide information that is correct, accurate, current and timely, we make no representations, warranties or covenants, express or implied, regarding PSC, including, without limitation, no representation, warranty or covenant that (i) the Material will be accurate, complete, current, reliable, timely or suitable for any particular purpose; (ii) that the operation of the PSC program will be uninterrupted or error-free; and (iii) that defects or errors with in the PSC program or in the Material will be corrected.

 

 

No Endorsements

Unless specifically stated, PSC does not recommend nor endorse any specific tests, health care professionals, products, procedures, opinions, or other information that appears or may appear in the Materials.  Reliance upon the information provided within PSC is solely at your own risk.

 

 

No Guarantee of Success:

While PSC provides you with tools, strategies, and guidance to support their health goals, there is no guarantee of specific results or success. Individual outcomes may vary, and Naturally Inclined Health does not give any assurance or warranty as to any particular results or success relating to the information contained in the Material.

 

 

Limitation of Liability

In no event shall Naturally Inclined Health, its officers, directors, employees, agents, licensors, contractors, and their respective successors and assigns be liable for damages of any kind, including, without limitation, any direct, special, indirect, punitive, incidental or consequential damages including, without limitation, any loss or damages in the nature of, or relating to, lost business, medical injury, personal injury, wrongful death, inaccurate information, improper treatment or any other loss incurred in connection with your use, misuse or reliance upon PSC  or the Material, regardless of the cause and whether arising in contract, tort, or otherwise. The foregoing limitation shall apply even if Naturally Inclined Health knew or ought to have known of the possibility of such damages.

 

Naturally Inclined Health also expressly disclaims any and all liability for the acts, omissions and conduct of any third-party user of the Site or Material, or any advertiser or sponsor of the Site.  Under no circumstances shall Naturally Inclined Health, its officers, directors, employees, associates, agents, licensors, contractors, and their respective successors and assigns, be liable for any injury, loss, damage (including direct, special, indirect, punitive, incidental or consequential damages), or expense arising in any manner whatsoever from (i) the acts, omissions or conduct of any third-party; and (ii) any access, use, reliance upon or inability to use any materials, content, goods or services located at, or made available at, any website linked to or from the Material, regardless of the cause and whether arising in contract, tort, or otherwise. Indemnification

You agree to indemnify and hold Naturally Inclined Health and its affiliates, directors, officers, employees, agents, contractors, suppliers and licensors, as applicable, harmless from and against any liabilities, losses, damages or costs, including legal fees and expenses on a solicitor-client basis, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your use of the Site and Material or your breach of any obligation, warranty, representation or covenant set forth in these Terms of Use, to the full extent permitted by applicable law.

 

Termination

Naturally Inclined Health may cancel or terminate your right to access PSC or any part of the PSC program at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the part of the PSC program affected by such cancellation or termination. The restrictions imposed on you with respect to the Material downloaded from PSC, and the disclaimers and limitations of liabilities set forth in these Terms of Use, shall survive.

Governing Law and Jurisdiction

You agree and hereby submit to the exclusive and preferential jurisdiction of the courts of Alberta with respect to all matters relating to your access and use of the Site as well as any dispute that may arise therefrom and that the applicable law shall be the law of Alberta.

 

Waiver

Any consent by Naturally Inclined Health to, or waiver of, a breach of this Agreement, which you have committed, whether express or implied, shall not constitute a consent to, or waiver of any other, different or subsequent breach.

 

Severability

The invalidity or unenforceability of any provision of these Terms or any covenant contained herein shall not affect the validity or enforceability of any other provision or covenant contained herein and any such invalid provision or covenant shall be deemed severable from the rest of these Terms.
